Workers’ Compensation Insurance: Frequently Asked Questions

What is workers’ compensation insurance?

Workers’ compensation insurance provides benefits to employees who are injured in a workplace accident, injured due to repetitive motion required by their job, or who become ill because of their work environment.

Yes! If you have employees, the state of Oklahoma requires that you have workers’ compensation insurance. If you don’t, you can be fined. An injured employee could also sue your business after an injury if you don’t have workers’ compensation insurance in place.

If an employee is injured in a workplace accident, workers’ compensation helps cover their medical expenses, lost wages, and rehabilitation costs. For more severe injuries, workers’ compensation may also cover disability benefits and death benefits for the employee’s family.

If you are using contractors in your business, you need to collect certificates of insurance to verify that each of those contractors has their own workers’ compensation insurance. Otherwise, your insurance company may consider contractors to be employees when determining your premium each year.

Consult your policy for specifics of what is or isn’t covered, but typically workers’ compensation insurance doesn’t cover injuries sustained while under the influence of drugs or alcohol, self-inflicted injuries, or injuries that are not work-related.

Some companies are exempt from the workers’ compensation insurance requirement. If you believe your company is exempt, you can file an affidavit of exempt status with the Oklahoma Workers’ Compensation Commission.
